Terms of use and sale

Pompon - Crochet débutant app. Last updated: 20 October 2026.

These terms are a translation of the French terms. If the two versions differ, the French version prevails.

1. Preamble

These terms of use and sale (the “Terms”) govern access to the mobile application “Pompon - Crochet débutant” (the “App”) and subscription to it.

The App is published by Lucas Carval, sole trader (French micro-entreprise) trading under the name Kerga Studio, SIREN 891 371 338, whose address is 11 Kergadoret, 29180 Quéménéven, France, and who can be reached at [email protected] (the “Publisher”). The full legal information is set out in the legal notice.

2. Definitions

3. Acceptance of the Terms

Using the App means full and complete acceptance of these Terms. Taking out the Subscription requires accepting them first.

The App is reserved for people aged fifteen or over.

4. Account

An anonymous account, with no email address or password, is created automatically the first time the App is launched. The Subscription is linked to the Google Play account used when subscribing. The “Restore purchases” feature lets you recover an active Subscription on a new device or after reinstalling, and link the projects of the previous account to it. If there is no Subscription to restore, a new empty account is created and the projects of the previous account can no longer be accessed.

The account can be deleted at any time in the App, in Me, then Settings, then “Delete my account”, under the conditions described in the privacy policy.

5. Subscription

5.1 Plans

Access to the Service requires a Subscription. Two plans are offered: an annual Subscription, with a free trial period of seven (7) days, and a monthly Subscription, with no trial period. The features and price of each plan are shown to the person using the App before any subscription, in the App and in the Google Play payment window.

5.2 Trial period

The trial period is free. Unless it is cancelled before the trial ends, the annual Subscription starts at the end of the trial period and the first payment is taken on that date. Only one trial period can be granted per Google Play account.

5.3 Price and payment

The applicable price is the one shown in the Google Play payment window at the time of subscribing, including all taxes where the rules of the country of residence impose a tax. It may vary by country. Payment is made only through Google Play, using the payment methods linked to the Google Play account. The Publisher never has access to payment data.

5.4 Renewal

The Subscription renews automatically for a period of the same length as the initial period, unless it is cancelled at least twenty-four (24) hours before the end of the current period. Renewal is at the price in force when subscribing, or at the new price notified by Google Play under the conditions set out in article 5.7.

5.5 Cancellation

The Subscription can be cancelled at any time from Google Play, under “Payments & subscriptions”. The “Manage my subscription” link, found in the App in Me, then Subscription, opens that section. Cancellation takes effect at the end of the current period, and access to the Service continues until that date. Deleting the account or uninstalling the App does not cancel the Subscription.

5.6 Promotional offers

The Publisher may offer promotional offers, whether temporary or not. Each offer is governed by the conditions shown when it is offered and, for anything they do not cover, by these Terms.

5.7 Price changes

The Publisher may change its prices. Any change that applies to an active Subscription is notified by Google Play before it comes into force and takes effect at the end of the current period. The consent of the Subscription holder is obtained where the rules require it. If the holder refuses, the Subscription can be cancelled under the conditions of article 5.5.

5.8 Refunds

Since payments are collected by Google Play, refund requests are sent to Google Play and handled under its rules, without prejudice to the right of withdrawal and the legal guarantee of conformity where they apply.

5.9 End of the Subscription

When the Subscription expires, access to the Service is suspended. The account's projects and patterns are kept for two years from that date and become available again if a new Subscription is taken out. After that period, the account and its content are deleted, under the conditions described in the privacy policy.

6. Right of withdrawal

Under Article L. 221-18 of the French Consumer Code (Code de la consommation), the consumer has fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without having to give a reason.

However, under Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not supplied on a tangible medium, or for a service fully performed before the end of the withdrawal period, where performance began after the consumer's prior express consent and express waiver of their right of withdrawal. By taking out the Subscription, the person using the App asks for immediate access to the Service and acknowledges that performance starts as soon as they subscribe, which means they waive their right of withdrawal from the start of their use of the Service.

Where the right of withdrawal still applies, it is exercised with Google Play, which collects the payment, or by an unambiguous statement sent to the Publisher at [email protected]. Where performance of the Service began at the consumer's request during the withdrawal period, the amount corresponding to the Service provided until they communicated their decision to withdraw remains payable, under Article L. 221-25 of the French Consumer Code.

7. Rules of use

The App is intended for strictly personal and non-commercial use. In particular, it is prohibited:

In the event of a breach, the Publisher may, after notice and except in urgent cases, suspend or terminate access to the Service, without prejudice to any claim for damages.

8. Usage limits

Features that use artificial intelligence (pattern generation, chat assistant) are subject to daily and monthly usage limits, set at a level suited to normal personal use. When a limit is reached, the feature concerned is suspended until the next period. The guide and the projects remain available. These limits may be adjusted.

9. Submitted Content

The person using the App keeps the rights in the Submitted Content. They grant the Publisher, free of charge, on a non-exclusive basis and worldwide, the right to store it, to pass it to the technical providers named in the privacy policy and to process it, solely to provide the Service, to understand the cause of an error and to improve the Service, without publishing it. This permission ends when the content concerned or the account is deleted.

They also authorize the Publisher to keep an anonymized copy of the text of their exchanges with the chat assistant, excluding any photograph, in order to improve and train an artificial intelligence model specialized in crochet. This copy, which is kept after the account is deleted, is not published, sold or used for advertising. The person can object to it at any time using the “Help Pompon answer better” setting. The details are given in the privacy policy.

The person using the App guarantees that they hold the necessary rights in the Submitted Content and undertakes not to submit content belonging to a third party without that party's permission. Generating a pattern from a post or a file is a private use. The Generated Pattern stays attached to the account and is neither published nor shared.

10. Generated Patterns

Generated Patterns are written by an artificial intelligence program, then checked by an automatic count of the stitches in each row. They are provided as is. They may contain errors or omissions, differ from the original item, include parts that were extrapolated where those parts were not visible, and their dimensions depend on the yarn, hook and tension used. The answers of the chat assistant are a help and not a guarantee. The quantities of materials stated must be checked before buying anything.

Any error found can be reported from the pattern page or from the guide.

11. Intellectual property

The App, its code, its layout, the Pompon character, the texts, the adaptations of the library patterns and the guides are protected by intellectual property law and belong to the Publisher or to third parties who have authorized their use. Some library patterns are adapted from works published under an open license or in the public domain. Their authors and licenses are listed on the credits page.

The Subscription grants a personal, non-exclusive and non-transferable right of use for the duration of the Subscription. It does not transfer any rights.

Generated Patterns are reserved for the personal use of the person who obtained them. Items made from these patterns can be kept, given away or sold. The pattern itself cannot be resold, published or distributed. Generating a pattern from a photograph, a post or a file gives no rights in the original item, whose author keeps all their rights.

The trademarks mentioned (in particular TikTok, Instagram, Pinterest, Amazon, Google) belong to their respective owners. The App is not affiliated with any of them.

12. Links to third-party sites

The App may contain links to third-party sites, in particular product pages on Amazon. These links are not affiliate links as of this version. Any change on this point will be stated in the App and in these Terms. The Publisher has no control over the content of these sites.

13. Availability and changes to the Service

The Publisher endeavors to keep the Service available, but cannot guarantee continuous availability. The Service may be interrupted, in particular for maintenance, if a provider fails, or when the distribution platform is updated. Some features need an internet connection. The guide and the projects remain available offline.

The Publisher may change the Service. If an essential feature is removed during a Subscription, the Subscription holder is informed and can cancel the Subscription under the conditions of article 5.5.

14. Liability

The Publisher is liable for direct and foreseeable damage resulting from a breach attributable to it. To the extent permitted by law, it cannot be held liable for:

These provisions do not limit or exclude the Publisher's liability for gross negligence or willful misconduct, nor the rights the consumer holds under the mandatory provisions of the French Consumer Code, in particular the legal guarantee of conformity for digital content and services (Articles L. 224-25-1 et seq.).

Making the items remains the responsibility of the person using the App. For an item intended for a young child, it is up to them to check that it is suitable for the child's age, in particular when it has small parts.

15. Personal data

The processing of personal data is described in the privacy policy. The account deletion procedure is described on the page pompon.lavenian.com/en/suppression.

16. Changes to the Terms

The Publisher may change these Terms, in particular to take account of changes to the Service or to the rules. Any substantial change is brought to the attention of the person using the App before it comes into force. If they refuse the change, the Subscription can be cancelled. Changes do not apply to periods already paid for.

17. Governing law and complaints

These Terms are governed by French law. A consumer resident in another country keeps the benefit of the mandatory provisions of the law of their country of residence.

Any complaint should first be sent to the Publisher at [email protected], in order to seek an amicable solution.

If no amicable solution is reached, the dispute is brought before the competent French courts, in compliance with the rules of jurisdiction that protect consumers.
